Conductor sues Union Pacific for dangerous condition at workplace

A conductor for Union Pacific Railway Co. has filed a lawsuit against his employer for failing to provide a safe working environment. The conductor filed the lawsuit at the end of May, about two months after he slipped and fell on a platform for the rail car he was working on. The conductor was trying to switch railroad cars, but a slippery substance on the platform caused him to slip and fall.

He suffered serious injuries as a result of the fall, include injuries to his neck, back, ankles and knees. The injuries were not fully described, but they were allegedly "disabling" according to the complaint. The lawsuit goes on to allege that Union Pacific failed to provide a safe place to work, failing to inspect its cars and appurtenances, and failing to warn of unsafe conditions. The lawsuit seeks compensatory damages for the pain and suffering of the plaintiff.

Railroads are dangerous places, and the people who work as conductors, in rail yards and along railroads are performing a very difficult job. It is made even more difficult when their employers are unwilling to comply with basic workplace safety requirements. Injuries are likely when unsafe conditions continue to exist.

It will be interesting to see where this case goes from here, but most cases like this end in settlements. Still, a settlement can earn the plaintiff the compensation he or she needs to deal with the fallout from the incident while still earning a modicum of justice for the incident.
